These Terms and Conditions govern your use of the Common Ground Pottery website and your purchase or use of classes, workshops, memberships, products, gift cards, loyalty rewards, and other services offered by Common Ground LLC, doing business as Common Ground Pottery (“Common Ground,” “we,” “us,” or “our”).

By using this website, creating an account, making a purchase, registering for a class, or participating in one of our programs, you agree to these Terms and Conditions.

2. Website Use

You may use this website only for lawful purposes. You agree not to:

Misuse the website or interfere with its operation
Attempt to access another customer’s account
Submit false or misleading information
Copy, reproduce, or commercially use website content without permission
Use the website in a way that violates applicable law or the rights of others

We may restrict or terminate access to the website when we reasonably believe these Terms have been violated.

3. Accounts and Customer Information

Certain features may require you to create a customer account.

You are responsible for:

Providing accurate and current information
Maintaining the confidentiality of your account credentials
Supervising activity performed through your account
Promptly notifying us of unauthorized account activity

Parents and legal guardians are responsible for registrations and purchases made for minors under their care.

4. Purchases and Payment Authorization

By submitting payment information, you represent that:

The information provided is accurate and complete
You are authorized to use the selected payment method
You authorize Common Ground to charge the posted price, including applicable taxes and fees
You agree to pay all charges associated with your purchase

Prices, schedules, instructors, offerings, and availability may change without notice.

5. Classes, Workshops and Courses

Registration is subject to availability and is not confirmed until payment has been successfully processed.

Customers are responsible for reviewing:

The class title and description
Dates and times
Age requirements
Experience requirements
Materials or clothing recommendations
Any additional instructions provided during registration

Customers should arrive on time. Late arrival may result in reduced participation time and may prevent participation when entering late would disrupt instruction or create a safety issue.

6. Cancellation and Rescheduling Policy

Cancellation or rescheduling requests must be made at least 48 hours before the scheduled start time of the booked class, workshop, course, or session.

Requests made within the required notice period may be eligible for rescheduling, exchange, credit, or refund, subject to the terms of the specific offering.

Cancellations made less than 48 hours before the scheduled start time are nonrefundable and nonexchangeable.

Failure to attend a scheduled class or workshop without proper notice is considered a no-show. No-shows are not eligible for a refund, exchange, credit, or rescheduling.

7. Cancellations by Common Ground

Common Ground may cancel or reschedule a class, workshop, or course because of instructor availability, low enrollment, emergencies, unsafe conditions, or other operational circumstances.

When Common Ground cancels an offering, affected customers will generally be offered one of the following:

A full refund
A credit toward another eligible offering
A transfer to a rescheduled session or comparable offering

Common Ground is not responsible for additional expenses incurred by customers, including transportation, lodging, childcare, or missed work.

8. Memberships and Recurring Payments

Certain memberships and plans automatically renew at the frequency disclosed during checkout.

By purchasing an automatically renewing membership, you authorize Common Ground and its payment processor to charge the payment method on file until the membership is canceled.

Memberships may be canceled at any time, but cancellation applies only to future renewal charges. Previously charged membership fees are nonrefundable.

Memberships:

Cannot be paused unless Common Ground agrees otherwise in writing
May not be shared or transferred
Are subject to studio rules and eligibility requirements
May include benefits that change over time

Common Ground may suspend or revoke a membership without refund when a member:

Violates studio or safety rules
Misuses equipment or materials
Threatens, harasses, or endangers another person
Damages studio property
Engages in fraudulent or disruptive conduct
Repeatedly fails to follow staff instructions

Customers should cancel before their next renewal date to avoid another charge.

9. Minors

A parent or legal guardian must complete registration and agree to all applicable terms and waivers for a minor.

A parent or guardian is not necessarily required to remain on-site during every children’s program unless stated in the program description or requested by staff.

Parents and guardians are responsible for:

Providing accurate emergency contact information
Informing staff of relevant pickup arrangements
Ensuring timely arrival and pickup
Explaining studio rules to the minor
Signing required safety, medical, photo, or participation waivers

Separate rules may apply to children’s clubs, camps, private events, and age-specific programs.

10. Arrival and Pickup of Minors

Children should arrive on time and be picked up promptly when the program ends.

Parents or guardians should notify Common Ground when they expect to be late.

Children should wait inside the studio until collected by an authorized adult. Parents and guardians are responsible for escorting children safely between the studio and their vehicle.

Common Ground may contact emergency contacts or take other reasonable action when a child is not collected on time.

11. Safety and Assumption of Risk

Pottery and ceramic activities may involve inherent risks, including risks associated with:

Clay, glaze, tools, wheels, kilns, and other equipment
Slippery, wet, sharp, heavy, or hot materials
Dust and airborne particles
Physical movement and repetitive activity
Accidental injury or property damage

Participants agree to:

Follow all safety rules
Listen to instructor and staff directions
Use tools, materials, and equipment responsibly
Notify staff of unsafe conditions
Refrain from using equipment they have not been authorized or trained to use

Participation may also require agreement to a separate adult or minor waiver and release.

To the fullest extent allowed by law, participants accept the ordinary risks associated with pottery and studio activities.

12. Clothing and Personal Property

Participants should wear clothing and shoes appropriate for a working pottery studio. Clay, glaze, paint, water, dust, and other materials may stain or damage clothing.

Aprons may be available, but they do not guarantee protection from stains or damage.

Common Ground is not responsible for lost, stolen, misplaced, or damaged personal property. Customers are encouraged to leave unnecessary valuables at home.

13. Finished Pottery and Firing Results

Pottery is a handmade process involving drying, glazing, firing, temperature variation, material behavior, and other factors that cannot always be controlled.

Common Ground does not guarantee that finished work will be free from:

Cracking
Breaking
Warping
Glaze variation
Discoloration
Kiln damage
Differences from samples or expectations

Any replacement, studio credit, refiring, or other remedy is offered at Common Ground’s discretion unless otherwise required by law.

Specific pickup deadlines and unclaimed-work policies may be communicated separately for a particular class or project.

14. Products and Merchandise

Product availability is not guaranteed.

Colors, sizes, measurements, finishes, and images shown online may vary from the actual product.

Merchandise rewards and promotional items are subject to stock and size availability. Common Ground may offer a substitute, delayed fulfillment, alternative size, or comparable reward when an item is unavailable.

15. Gift Cards

Common Ground gift cards:

Do not expire
Are nonrefundable
Are not redeemable for cash, except where required by law
May be used only for eligible Common Ground purchases
May be replaced when lost or stolen only when the customer can provide sufficient purchase or ownership information

Gift cards may not be used to purchase additional gift cards unless Common Ground permits otherwise.

Promotional certificates or complimentary credits may be subject to separate conditions.

16. Pottery Perks Loyalty Program

Common Ground may offer a loyalty program known as Pottery Perks.

Earning points

Unless otherwise stated, members earn one point for every eligible dollar spent.

Points are not earned on:

Taxes
Tips
Gift-card purchases
Refunded or canceled purchases
Other excluded charges identified by Common Ground

Points may take time to appear in a customer’s account.

Redeeming points

Points may be exchanged only for rewards currently offered through the program.

Rewards:

Have no cash value
Cannot be sold or transferred
May not be combined with other discounts unless permitted
Are subject to eligibility, availability, and system limitations
May be limited to participating products, services, or bookings
May require the customer to be logged into the correct account

Points do not expire under the current program rules.

Refunds and adjustments

If a purchase is refunded, reversed, disputed, canceled, or determined to be ineligible, Common Ground may remove points earned from that transaction.

Common Ground may correct balances affected by technical errors, duplication, fraud, misuse, or administrative mistakes.

Program changes

Common Ground may modify, suspend, replace, or discontinue the loyalty program or any reward at any time.

This includes changing:

How points are earned
Point values
Reward levels
Eligible transactions
Redemption rules
Available merchandise or services
Program technology or providers

Changes will not convert points into cash or create a right to compensation.

17. Promotional Codes and Discounts

Promotional codes and discounts:

May be limited to certain products or services
May have expiration dates
May be limited to one use
May not be combined
Have no cash value
May be withdrawn in cases of error, misuse, or fraud

Unless otherwise stated, discounts apply only to the eligible purchase subtotal and not to taxes, tips, or fees.

18. Photography and Media

Common Ground may request permission to photograph or record studio activities, students, participants, and events for advertising, social media, website content, educational material, or promotional use.

Where required, photo and media permission will be obtained through a separate waiver or consent process.

Customers should contact Common Ground before participation if they do not want themselves or their child photographed.

19. Intellectual Property

All website content, including logos, graphics, photographs, videos, text, class materials, designs, and branding, is owned by or licensed to Common Ground and is protected by applicable intellectual-property laws.

Customers may not reproduce, distribute, publish, sell, or commercially exploit this content without written permission.

Participants retain ownership of original artwork they create, subject to any separate photo or promotional permission they provide.

20. Third-Party Services

The website may use third-party services for:

Website hosting
Scheduling and bookings
Payments
Email communication
Customer accounts
Loyalty programs
Analytics
Social media

Common Ground is not responsible for outages, errors, security incidents, or policy changes caused by third-party providers outside its reasonable control.

Use of those services may also be governed by the provider’s own terms and privacy policies.

21. Disclaimer of Warranties

The website and services are provided on an “as available” basis.

To the fullest extent allowed by law, Common Ground does not guarantee that:

The website will always be available or error-free
Every class, product, instructor, or feature will remain available
Pottery will produce a particular artistic or technical result
Digital information will always be accurate or complete
Third-party systems will function without interruption

Nothing in these Terms excludes rights that cannot legally be waived.

22. Limitation of Liability

To the fullest extent permitted by law, Common Ground LLC and its owners, employees, instructors, contractors, and affiliates will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the website, participation in activities, or purchase of services or products.

Where liability cannot be excluded, Common Ground’s total liability will be limited to the amount paid for the specific product, class, membership, or service giving rise to the claim, except where a different limitation is required by law.

This section does not replace any separately signed participation waiver.

23. Indemnification

To the extent permitted by law, you agree to defend and indemnify Common Ground LLC and its owners, employees, instructors, contractors, and affiliates from claims, damages, losses, and expenses arising from:

Your violation of these Terms
Your unlawful use of the website
Your misuse of studio property or equipment
Your intentional or negligent misconduct
Information or content you submit

24. Governing Law and Venue

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.

Any legal action arising from these Terms or Common Ground’s services must be brought in a court with appropriate jurisdiction located in Clark County, Nevada, unless applicable law requires otherwise.

25. Changes to These Terms

Common Ground may update these Terms periodically.

The updated version will be posted on the website with a revised “Last updated” date. Continued use of the website or services after an update constitutes acceptance of the revised Terms where permitted by law.

Material changes affecting recurring memberships or paid services may also be communicated through email, account notices, or other reasonable means.

26. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect.

27. Entire Agreement

These Terms, together with applicable waivers, checkout terms, membership agreements, class descriptions, privacy policies, and other posted policies, constitute the agreement between the customer and Common Ground regarding the relevant website use or transaction.

If a specific written policy conflicts with these general Terms, the more specific policy will control for that transaction.
